The session provides an overview of various unfair dismissal experiences from both sides of the employment relationship. The session covers typical employer (Respondent) experiences, and also employee (Applicant) experiences. The session contrasts those experiences and highlights the different strategies, tactics and positional strengths and weaknesses experienced by the various parties.
Participants will gain unique and practical first-hand insights into the unfair dismissal scheme through real-life examples of difficult dismissal disputes. Attendees will become better equipped to deal with unfair dismissal processes having had an understanding of what goes on for both sides of the dispute.
HR professionals are regularly required to advise and partner with line management during disciplinary processes, restructures and other interventions which often result in the termination of employment. Demystifying the risks and understanding the scheme will improve advice and ensure advice is competent, balanced and consistent with law.
The forum will commence with a presentation followed by a Q&A session on the issues that the presentation covers.

Speaker: Damien Marshall, Lawyer, Marshall Workplace Law
Damien has over 20 years of industrial relations, employee relations and human resource management experience having worked in a variety of HR roles at Singtel Optus and more recently as the Head of Employee Relations at Ampol Australia (formerly Caltex Australia).
Damien is a qualified lawyer operating a workplace law practice having previously worked
as a Senior Lawyer and Adviser at the Australian Industry Group.
Damien holds a Master of Industrial Relations & Human Resource Management from the University of Sydney and a Juris Doctor from the University of Technology Sydney.
